Dear Commerce Commission,
**Complaint regarding misleading use of the word “free” by the New Zealand Labour Party**
I am writing to raise a concern about the New Zealand Labour Party’s public advertising and promotional material using the word “free” to describe services that are not, in fact, free.
On Labour’s website, Labour describes several policy promises using the word “free”, including:
These services are not free. They are paid for by taxpayers.
In Labour’s own material regarding doctor’s visits, Labour states that the policy would be paid for by a targeted tax on certain property profits. That means the cost is not removed. It is transferred.
One group of New Zealanders pays through tax. Another group receives the service without paying directly at the point of use.
Calling that “free” is, in my view, dishonest and misleading.
A more accurate description would be “taxpayer-funded”, “publicly funded”, “subsidised”, or “paid for through taxation”.
The ordinary meaning of the word “free” is that there is no cost. But in this case there is a cost. It is merely hidden from the person using the service and imposed on other people through the tax system.
I ask the Commerce Commission to consider whether the repeated use of the word “free” in this context creates a misleading overall impression for the public.
I also understand the Commission may need to consider whether political advertising falls within its jurisdiction under the Fair Trading Act or other legislation. If the Commission considers this outside its enforcement scope, I would appreciate confirmation of that position and guidance on which agency or complaints body should review this issue.
My concern is not with the political policy itself. Political parties are entitled to advocate for taxation and spending. My concern is with the accuracy of the language used to promote it.
A product, service, or benefit funded by compulsory taxation is not free.
It is paid for by someone else.

Dr. S. L. Malhotra (often cited as S.L. Malhotra) published “Epidemiology of ischaemic heart disease in India with special reference to causation” in the British Heart Journal in November 1967 (Volume 29, Issue 6, pp. 895–905).
Malhotra controlled for factors like smoking (which was higher in the North), socioeconomic status, and physical activity as best he could in a retrospective analysis. He concluded that the type and amount of fat in the diet was the strongest correlating factor.

Researchers at Stanford University have identified a possible reason why a small number of people, especially young males, develop myocarditis (inflammation of the heart muscle) after receiving an mRNA COVID-19 vaccine.
They found that people who developed myocarditis had higher levels of two immune-system chemicals in their blood: CXCL10 and interferon-gamma (IFN-γ).
The process appears to work like this:
The vaccine triggers immune cells called macrophages to produce CXCL10.
CXCL10 attracts T cells, another type of immune cell.
The T cells release IFN-γ.
IFN-γ attracts more inflammatory cells, including neutrophils and macrophages, into the heart.
These immune cells can cause inflammation and damage to heart tissue, leading to myocarditis.
In laboratory studies using mice and human heart tissue, researchers found that blocking CXCL10 and IFN-γ greatly reduced heart inflammation and damage. Importantly, blocking these inflammatory signals did not appear to reduce the vaccine’s ability to stimulate an immune response.
The researchers also tested genistein, a natural compound found in soy. When given before vaccination in these experimental models, genistein reduced the rise in inflammatory cytokines and lessened heart damage.
The paper claims vaccine-associated myocarditis is uncommon.
However almost 500 New Zealanders met duel criteria for being in a post vax HNZ myocarditis study by lare 2022, that was published in Sept 2024. At least 4 young New Zealanders were found by the coroner to have died from post vax myocarditis or pericarditis.
Symptoms of myocarditis may include:
Chest pain
Shortness of breath
Heart palpitations (feeling the heart racing or skipping beats)
The highest reported rates are in adolescent and young adult males, with approximately 1 case occurring for every 9,000 to 25,000 vaccine doses in the highest-risk groups. It is unknown how many cases are unreported.
The study’s findings may help researchers develop ways to prevent or treat vaccine-associated myocarditis in the future.

National has launched a fresh attack on NZ First at the party’s annual conference today, with campaign chair Simeon Brown telling New Zealanders they “can’t trust” Winston Peters’ party not to go with Labour after the election.
That’s despite Peters saying in April that NZ First “won’t do a deal with Labour” and confirming “nothing has changed” since his 2022 promise to rule out working with the party.
Brown, speaking to members gathered in Lower Hutt on Sunday morning, was stressing the importance of the party vote to National’s electoral prospects when he took a crack at the party’s current coalition partners, NZ First and Act.
He used an analogy seemingly to explain the coalition dynamics, indirectly comparing National to a “Mum or Dad” in a household, while the other coalition partners are distracting children.
“Every working family knows how it goes. Mum or Dad gets up early. Lunches made, bills paid, the whole house out the door on time. The household runs, and it runs well,” Brown said.
“There are two kids in this house. They get on fine with Mum and Dad, but not always with each other. One wants the heater on, the other throws the window open. One wants the rugby on, the other wants football. It’s up to Mum and Dad to keep the peace.
“None of it breaks the household – it’s just a distraction.”

He said energy needed to be spent “refereeing” the siblings “instead of building the family’s future”.
“You know who those two kids are, with Mum and Dad in the middle, finding the time in all the noise, to get on and get the job done,” he said.

Brown was then explicit: “Don’t vote for Act or NZ First thinking it helps National”.
“It doesn’t. A party vote for New Zealand First grows New Zealand First. A party vote for Act grows Act. Neither grows National.”
He then turned to NZ First’s history of propping up previous Labour Governments, including noting that in 2017 “a party vote for NZ First was a party vote for Jacinda Ardern, Chris Hipkins and James Shaw”.

I’ve always said that total remuneration system is wrong. Employer contribution should be on top of salary. In terms of salary sacrifice unless your tax rate is above the top KS rate of 28% there would be no point but as far as I know there is nothing y to stop this being negotiated with the employer

**Complaint regarding misleading use of the word “free” by the New Zealand Labour Party**
I am writing to raise a concern about the New Zealand Labour Party’s public advertising and promotional material using the word “free” to describe services that are not, in fact, free.
On Labour’s website, Labour describes several policy promises using the word “free”, including:
* Free Doctor’s Visits
* Free prescriptions
* Free Maternity Scans
* Free Cervical Screening
The concern is simple.
These services are not free. They are paid for by taxpayers.
In Labour’s own material regarding doctor’s visits, Labour states that the policy would be paid for by a targeted tax on certain property profits. That means the cost is not removed. It is transferred.
One group of New Zealanders pays through tax. Another group receives the service without paying directly at the point of use.
Calling that “free” is, in my view, dishonest and misleading.
A more accurate description would be “taxpayer-funded”, “publicly funded”, “subsidised”, or “paid for through taxation”.
The ordinary meaning of the word “free” is that there is no cost. But in this case there is a cost. It is merely hidden from the person using the service and imposed on other people through the tax system.
I ask the Commerce Commission to consider whether the repeated use of the word “free” in this context creates a misleading overall impression for the public.
I also understand the Commission may need to consider whether political advertising falls within its jurisdiction under the Fair Trading Act or other legislation. If the Commission considers this outside its enforcement scope, I would appreciate confirmation of that position and guidance on which agency or complaints body should review this issue.
My concern is not with the political policy itself. Political parties are entitled to advocate for taxation and spending. My concern is with the accuracy of the language used to promote it.
A product, service, or benefit funded by compulsory taxation is not free.
It is paid for by someone else.
