    • Well i rekon they need to go install sharp blades on every powerpole, if a clean cut was made to that car rather then the horrofic blunt impact then possibly lives would be saved.

      Such a sad event tho, i lost multiple freinds and classmates on nseveral occasions when we hit that age, 1 really hit when 2 killed and 1 good mate were crictically injured in a middle of the night crash and our schoolbus went past the next morning and the mangled wreck was still wrapped around the tree stump.

      • That must have been tough, I wonder how many of those pupils retained that scene and the consequences forever, we were all so bullet proof in those days. I worked with a young 18 year old, was on the desk beside me, who was killed when he drove into a pole on Tram Road, Rangiora about 50 years ago. Never forgotten that but I know I never thought about it when out boozing/driving in those formative years.
        Never mind though, the driver has put out a Facebook entry from the hospital bed saying how sorry he is that his car is wrecked – no sorry that he killed 5 15/16 year olds. I do wonder just what will the judge do with him?

        • Phil, some time later they bought the car to the school so everyone could see it. The shock factor was huge for many, i remember quite a few ppl vomiting etc at the sight of ot as there was still a hell of alot of dried blood staining etc. Of the 4 occupants only 1 wore a seatbelt… they were unscathed and ran for help.
          Dont know if seatbelts would have saved many of those kids in timaru tho as the car was that totalled.

      • IAASB, that wouldn’t happen these days ,half the kids in their school will have a week off with stress leave, wanna be child psychologists will descend by the dozen, tons of flowers will turn up on the side of the road placed there by little kids that never even knew these 15 year olds and mothers that had never heard of the poor buggers that died will fight for a chance of make a statement in front of the TV camera teams that will stay for days in case something in the 19 year old drivers past comes out…

    English Pharmacy Board chair Thorrun Govind has written to Nadhim Zahawi, the minister responsible for Covid vaccine deployment, to express her concern that pharmacies taking part in the vaccination programme this autumn and winter will no longer be insured by the government.

    In her letter to Mr Zahawi, Ms Govind (pictured) said she was “surprised and concerned” that pharmacists providing Covid jabs as part of phase three of the roll-out will have to pay for their own indemnity and called on him to “look into this as soon as possible to treat pharmacists fairly”.

    I was somewhat surprised by the response I got to the first FOI request that I’ve copied below:

    “Regarding your request, dated 14 July 2021, for supporting documentation for full nucleotide base sequence for the mRNA used in both the Pfizer and Moderna COVID vaccines and full nucleotide base sequence used in the recombinant DNA of the Oxford-AstraZeneca and Johnson and Johnson vaccines is exempt under Section 41 (Information provided in confidence) and Section 43 (Commercial interests) of the Freedom of Information (FOI) Act.
    Section 41 is an absolute exemption and no consideration of the public interest is required, except to state that we consider its disclosure to constitute an actionable breach of confidence.

    Section 43 is a qualified exemption and a consideration of the public interest should be made. We have considered the public interest and cannot see any public interest argument that outweighs the commercial harm in providing commercial secrets to competitors, who would be able to use this information to aid the development of their own rival product”

    This time, a small group of trade union officials, business representatives and public servants is busy developing a scheme that would introduce a two-tier benefit structure into the welfare system.

    And it appears the government is only promising a discussion document once the shape of such a scheme is formulated. It’s expected this will present a single preferred social insurance policy option, no non-insurance alternatives, and a plan to have legislation passed before the next election.

    What is clear, however, is a social insurance scheme (sometimes being referred to as a social unemployment insurance scheme) will almost certainly favour those with higher long-term incomes at the expense of those on the lowest incomes. Others, like many school leavers, sole parents and people with disabilities, won’t qualify at all.

I’m sending this note just to those like you who supported our predecessor organisation, the Free Speech Coalition, to update you on our litigation that saw us start this cause back in 2018 in response to Phil Goff’s outrageous statements (which turned out to be untrue!) that he had ‘banned’ two controversial Canadian speakers.

    We have some great news to report – the Supreme Court has granted us leave to appeal the Court of Appeal’s substantive decision. In short, that means the Supreme Court has agreed with us that the case raises important legal questions on a matter of general public importance worthy of the Court’s time (there is no automatic right to appeal and very few are granted leave).

    The Free Speech Coalition (now Union) was born out of an effort to crowdfund for this legal fight after Mayor Phil Goff ostensibly ‘banned’ two controversial Canadian speakers, Lauren Southern and Stephen Molyneux, from speaking at a Council-owned venue because he deplored their views.

    Once we filed the High Court proceedings, it was revealed that Mayor Goff did not personally make the decision to cancel the event despite having gloated on Twitter and on Radio NZ that he did. Rather, the decision was made by Regional Facilities Auckland Ltd (RAFL) personnel only hours after receiving an email threat from Auckland Peace Action to blockade the event venue four weeks before the event was to take place. No investigation into the credibility of the threat or what measures might have been taken to manage it took place at any stage.

    Though we were forced to abandon the application for injunctive relief (asking the High Court to reverse the Mayor’s apparent decision and force the re-establishment of the particular event) we decided to proceed to the substantive judicial review on the basis that we couldn’t allow the situation where councils curtail to the ‘thug’s veto’.

    We were shocked when the High Court ruled that our plaintiffs were on a “personal crusade” and didn’t have standing to bring the case. The Court also held that the decision to cancel the event was not judicially reviewable because RFAL’s decision did not, in the Judge’s opinion, involve an exercise of public power and the venues were technically held in trust.

    To our relief, the Court of Appeal reversed the most disturbing parts of the High Court Judgement, holding that RFAL must uphold free speech rights as if it were the Council. It also held that our plaintiffs did have standing to bring the case and we were relieved by the appeal decision to cut the costs awarded against us by 70% because of the importance of the issues and public interest in our bringing the case.

    That being so, the Court of Appeal ultimately found the decision to cancel the event to be a ‘justified limit’ on freedom of expression. Under section 5 of the New Zealand Bill of Rights Act, the rights contained within can be ‘justifiably limited’ but only by “such reasonable limits prescribed by law as can be demonstrably justified in a free and democratic society”.

    In holding that the decision to cancel the event was a justified limit on free expression, the Court of Appeal considered the purported failings of the event organisers (in particular the Court of Appeal was critical of the event organisers for not warning RFAL venue management of the possibility of law-breaking protest at the time of booking), the experience of RFAL personnel, the venue hire agreement and the protest noise over the preceding week. The Court of Appeal held that the “heckler’s veto” concept we put forward had a general application as part of the section 5 analysis but did not go on to analyse it or consider its implications under section 5 in any detail.

    To recap, we won:

    on the point that Bill of Rights Act obligations (including freedom of speech) apply to councils and their subsidiaries that control public venues. In other words, Councils can’t hide behind “independent” managers – the Court of Appeal overruled the High Court on this point;
    in a terse reversal of the lower court’s incomprehensible ruling that we were not bringing a case of public interest and importance;
    in a similarly brusque dismissal of the lower court’s decision that our representative plaintiffs were on a personal crusade and did not have standing to bring the case;
    in statements about the importance of free speech and obligations not to assert health and safety fears without proper foundation; and
    in getting the costs award against us cut by 70%, because of the public interest nature of our case. This is an unusually large discount. We could say it suggests we have been upheld 70% and lost as to 30% but that is not necessarily the way these things are calculated.

    We lost:

    on our key argument that the cancellation decision should have been made after much more investigation of ways to diminish the protestor threats to health and safety. The Court of Appeal says the speaking tour organisers were not upfront enough with the venue managers about the protest risks. We think this is a shame. In other contexts victim blaming is called out, but not this time;
    in that the Court fails to give a clear steer on just how important it is to ensure that Thugs’ Veto does not win. The judges have weaved around the issue, saying we do not have US-style law, and citing similar Canadian evasions where thugs have defeated free speech. They say our judges will have to develop law that suits New Zealand, but don’t take the opportunity to do so; and
    in that the Court treated our withdrawal of our lawsuit against the Mayor as if it made his false claim immaterial. We hoped that the Court would mention the context of the case, in that it came about when the Mayor claimed publicly that he’d banned the speakers from Council venues. As it turned out he was lying but the Court just didn’t go on to say directly that if his claim had been true, it would have been unlawful. We think that conclusion underlies the decision, but it would have been better to have it stated clearly.

    The Court of Appeal judges stopped after describing the thug’s veto problem as if solving it was not their job, instead treating it like some sort of abstract long-term project when they had a perfect opportunity to address it head-on. We asked them to say how much should be done about thuggish threats before they can override free speech rights but after summarising the different approaches in other countries, they passed that ball into space – they basically didn’t pick a side.

    So we decided to seek leave to appeal to the Supreme Court. Backing our case, Professor Philip Joseph, the author of New Zealand’s leading textbook on Constitutional and Administrative Law, has volunteered to support the Free Speech Union’s lead barrister Jack Hodder QC before the Supreme Court.
    What’s next?

    While the Court of Appeal Judgement represented a substantial improvement on the High Court Judgement, it leaves the right to freedom of expression vulnerable to vague threats of violence. Free speech rights in public spaces and venues across New Zealand need protection from such a dangerous precedent. As it stands, the Court of Appeal Judgement allows a threatened unlawful action (a blockade, with an implicit threat of intimidation) to effectively curtail the lawful exercise of fundamental rights.

  27. Last night I saw some figures for the viewing of Nigel Farage’s show on GB News. It was something like 160K and they said this was more than the BBC and Sky News combined. I presume it was for a particular time slot. They are very numbers so it shows what a small percentage of the population take an interest in the news. You see the same in the USA. Tucker Carlson is top news guy but his viewing figure are only about 3million (last time I saw them a few months ago) . It shows how politicians can get away with a lot things –people are just not up to date with what is going on.

    • More evidence that the Vaccine is not what they say it is. From my understanding, a general principle of vaccines is that if a vaccine is doing its job correctly, the only reaction/side effect of the vaccine, is the same reaction your body would have if it was fighting the real thing.

      I’m not a flu vaccine advocate, but the effect of a flu vaccine should at worst be the same as getting the flu. e.g. runny nose, chest pains, high temperature, fever etc. Some of these effects are not caused by the flu, but the body’s attempt to deal with the flu, and expel the flu from your body. So it makes sense that a flu vaccine may, but not always produce similar symptoms, and not in all people. Some people with better immune systems can fight off the flu, without raising a sweat – literally.

      Vaccines have historically been dead virus/bacterial material, so that the body can get a good look at what the invader looks like, sample it, and produce anti-bodies without the invader fighting back.

      Side effects that do not match the body’s response to any virus vaccine are suspect.

        The spike protein carries large positive electrical charge, which impacts the ability of the body to absorb oxygen. This results in Hypoxemia / Hypoxia and literally starves the body of oxygen.         If the/any Covid vaccines is to be effective, it has to produce anti-bodies that enable the phages / macrophages to attack / kill / devour and ‘rugby tackle’ / ‘pounce on’ the invaders and have them carried safely out of the lungs on the lungs conveyor belt – the mucous / cilia hairs that line the inside of the lungs.

        We know, and the authorities admit, that the vaccine does not stop you getting infected, and by implication stop the virus replicating, nor does it stop you re-transmitting the virus, but it “might” lessen the effects. Something that anti-parasiticals would do a better job of. Putting it simply, the vaccine does fuck all good.

        If you compare the virus to a grizzly bear you are hunting, or if it is hunting you, any good hunter will tell you when you encounter the bear, you need to have a gun big enough to kill it, and you shoot to kill. Because if you only give it a slight flesh wound, you will piss it off and it will not stop until it catches you and tears you limb from limb. Even if you are lucky to outrun it, it may track you by scent and attack you at your campsite. Going after Covid-19 with a lame vaccine, is like going after a bear with a slug gun. Clearly the vaccine is not teaching the body’s defenses to recognise Covid-19, and in addition is wrecking havoc and creating it’s own damage.

        You don’t have to be a rocket scientist to work out that it the vaccine does not enable your body to kill the virus, and stop it getting past your lungs’ defenses, and allowing it to gain hold in your body, it will replicate. Has not the fear porn pundits told us the virus is way smarter than your average bear virus? Virus usually mutate, but this one is a shape shifter. So if you piss off the virus with a lame vaccine that does not empower your body to kill it, it will mutate to survive. Hence the continual variants.
